Rescheduling the appointment does not entitle the customer to a discount and does not render VeraGlas B.V. liable for any loss and/or damage suffered by the customer.

VeraGlas B.V. may engage third parties for the partial or full performance of the assignment. If a third party is engaged, the customer will be informed in good time. Liability arising from the acts and/or omissions of that third party lies entirely with that third party.

The customer must ensure that the area where VeraGlas B.V. will perform the service is ready and workable. If this is not the case, VeraGlas B.V. will be forced to reschedule the appointment. If specific agreements have been made in this respect and the customer has failed to comply with them for a reason and/or circumstance not covered by force majeure, VeraGlas B.V. is entitled to charge the hourly wage of its fitter(s) or the costs of the fitter(s) it has hired.

If the customer obstructs the performance without justified grounds, interest will be charged. If the customer persists in this attitude, VeraGlas B.V. is entitled to dissolve the agreement and to charge the costs connected with the failure of the agreed assignment.

If the performance of the assignment takes place in instalments in consultation with the customer, VeraGlas B.V. may invoice each part separately. Aftercare relates exclusively to what VeraGlas B.V. has carried out and not to modifications made by the customer and/or third parties.

If the customer requests aftercare for something that has been modified by a party other than VeraGlas B.V., VeraGlas B.V. is free to grant or refuse this request. If VeraGlas B.V. wishes to accommodate the customer, the customer shall bear the costs of the aftercare of the third party's work. Any liability, warranty and risk shall be entirely at the customer's expense.

The globally accepted tolerance applies to any flaw or scratch on the glass that is not visible from a distance of three (3) metres or more. Cancellation free of charge is possible up to seven (7) days before performance of the agreed service.

If cancellation takes place within fourteen (14) days before performance of the agreed service, the customer must still pay thirty per cent (30%); this amount will be set off against the payment already due upon acceptance of the offer.

In the event of cancellation up to 24 hours before commencement or during the performance of the service, the full costs must be paid, with the exception of costs that no longer need to be incurred after cancellation, including – but not limited to – material that would still have been ordered during performance had the assignment gone ahead, or the engagement of an expert who would not have had to be engaged with certainty.

Material is not included in the cancellation costs, unless special material was ordered at the customer's request and/or VeraGlas B.V. had to process the material, in the broadest sense of the word. In that case, these costs will also be charged in all reasonableness. Reasonableness means assessing whether the material can still be used for other assignments. If the material is no longer usable, the full costs of that material will be charged. If the specially ordered material can be used for other assignments, but the possibilities for doing so are minimal, not the full amount but an amount proportional to the possibility of use will be charged.

Article 15 – Force majeure

Force majeure exists if the situation is not attributable to either party and cannot be imputed to them.
